Welcome to creative.ky, the website of Creative Exposure.
These Terms and Conditions govern your access to and use of creative.ky, including your use of our online ordering, quote-request, artwork-upload, account and related services.
By accessing or using this website, creating an account, submitting a quote request, uploading artwork, or placing an order, you agree to be bound by these Terms and Conditions and by any additional requirements, specifications or policies presented in connection with a particular product or service.
Creative Exposure may update these Terms and Conditions from time to time. The current version will be published on creative.ky. Your continued use of the website after changes are published constitutes acceptance of the updated Terms and Conditions.
Where appropriate, Creative Exposure may provide notices, order communications, approvals and other business communications electronically, including through email, your customer account or other contact methods you provide to us.
1. Copyright and Website Content
Creative.ky may contain photographs, graphics, illustrations, product images, layouts, artwork, text, branding, design elements, software, templates and other materials collectively referred to as “Content.”
Unless otherwise stated, this Content is owned by Creative Exposure or used with appropriate authorization.
You may use the Content only for the purpose of viewing, evaluating, purchasing or requesting Creative Exposure products and services.
You may not copy, reproduce, distribute, publish, modify, sell, license or otherwise use Creative Exposure Content for commercial purposes without prior written permission.
Downloading an artwork template or other customer resource from creative.ky does not transfer ownership of Creative Exposure intellectual property or grant permission to use Creative Exposure branding or other protected Content outside its intended purpose.
2. Use of the Website
You agree to use creative.ky only for lawful purposes and in accordance with these Terms and Conditions.
You may not use Creative Exposure or its services to create, submit or order material that:
- infringes another person’s copyright, trademark or other intellectual property rights;
- violates another person’s privacy or publicity rights;
- is unlawful, fraudulent, defamatory, threatening or malicious;
- contains material that you do not have permission to reproduce; or
- otherwise violates applicable law.
Creative Exposure reserves the right to refuse any order, artwork, project or request that we reasonably believe violates these requirements or is otherwise inappropriate for us to produce or provide.
3. Customer-Supplied Artwork and Content
You are responsible for all artwork, photographs, logos, text, trademarks and other materials you provide to Creative Exposure.
By submitting artwork or placing an order, you confirm that you have the legal right and authority to use, reproduce and authorize the production of all materials contained in your order.
You authorize Creative Exposure to use the materials you provide as necessary to prepare, manage and complete your order.
Creative Exposure is not responsible for claims arising from materials supplied by a customer without the necessary copyright, trademark, licensing or other permissions.
4. Artwork Templates
Creative Exposure may provide downloadable artwork templates to assist customers with preparing files for specific products, sizes and print configurations.
Customers are responsible for selecting the correct template for the product being ordered and following the instructions contained in that template.
Templates must not be resized, altered or used for a different product or configuration unless Creative Exposure confirms that doing so is appropriate.
Templates are provided as preparation resources and do not guarantee that customer artwork is print-ready.
5. Artwork Approval and Proofs
Customers are responsible for carefully reviewing all artwork and proofs before providing final approval.
This includes checking:
- spelling;
- names and contact information;
- dates;
- dimensions;
- quantities;
- positioning;
- image quality;
- orientation;
- colors;
- design content; and
- any other customer-supplied information.
Once a customer provides final written approval, Creative Exposure may proceed with production based on the approved artwork.
Creative Exposure is not responsible for errors that were present in customer-supplied artwork or in a proof that the customer approved.
Verbal approval alone should not be relied upon as final artwork approval where written approval has been requested.
6. Orders Placed Without a Proof
Where Creative Exposure permits an order to proceed without a proof or allows customer-supplied artwork to be produced as submitted, the customer assumes responsibility for errors contained in the submitted artwork.
Creative Exposure will not be responsible for spelling, layout, content or other customer-created errors that were not introduced by Creative Exposure.
7. Color Accuracy
Customers should understand that colors displayed on phones, computers and other screens may differ from printed colors.
Digital proofs and screen previews cannot guarantee an exact color match to a finished printed product because screens and printing processes reproduce color differently.
Reasonable color variation between a digital display, proof, previous order or finished printed product does not necessarily constitute a defect.
Where exact color matching is important, the customer should advise Creative Exposure before production.
8. Pricing and Currency
Prices displayed on creative.ky are in Cayman Islands dollars (KYD) unless otherwise stated.
Product pricing may depend on the selected size, quantity, material, finishing options and other configuration choices.
Certain products or services are available only by quotation.
Creative Exposure reserves the right to correct genuine pricing, calculation or configuration errors before production begins. If such an error materially affects an order, the customer will be contacted before the order proceeds.
9. Minimum Order Value
Creative Exposure has a CI$60 minimum order value for online purchases.
Where the configured cart subtotal is below the minimum, an adjustment may be added to bring the order total to CI$60. Any such adjustment must be disclosed before the customer completes checkout.
10. Payment Terms
Creative Exposure accepts approved forms of payment including:
- bank transfer;
- cash; and
- cheque.
Creative Exposure does not currently process credit or debit card payments through creative.ky.
For standard customers:
Orders of CI$500 or less require full payment before production begins.
Orders over CI$500 require a 50% deposit before production begins, with the remaining 50% due before delivery.
Orders totaling exactly CI$500 require full payment before production.
Approved corporate credit customers and verified government purchase-order accounts may be permitted to operate under separately approved payment terms.
Submitting a purchase order does not automatically establish credit terms unless those terms have been approved by Creative Exposure.
11. Payment Confirmation
Where payment is made by bank transfer, Creative Exposure may request confirmation or proof of payment before production begins.
Customers should ensure that payment information provided to Creative Exposure is accurate.
Payment instructions supplied by Creative Exposure should be followed carefully.
12. Order Cancellation
Because many Creative Exposure products are custom-made or produced specifically for an individual customer, an order may not be cancelled once:
- final artwork has been approved; and
- production has begun.
Payments relating to work already approved and placed into production are generally non-refundable for cancellation or change-of-mind requests.
This cancellation provision does not prevent a customer from reporting a genuine production defect or an error caused by Creative Exposure.
If you need to cancel or change an order, contact Creative Exposure as soon as possible. We will confirm whether the order has reached a stage at which cancellation or modification is no longer possible.
13. Changes After Approval
Changes requested after final artwork approval may require the project to be stopped and restarted where that remains possible.
Additional charges may apply where work has already been completed, materials have been committed or a new file must be prepared.
Creative Exposure will advise the customer before proceeding with chargeable changes.
14. Production Turnaround
Creative Exposure’s standard turnaround for products is generally 6-10 business days.
Turnaround begins only after all requirements necessary to begin production have been satisfied, which may include:
- final artwork approval;
- receipt of required payment or deposit;
- confirmation of specifications; and
- any other information required to complete the order.
Turnaround estimates are not guaranteed delivery dates.
Rush work may be available. Please WhatsApp or email us to confirm availability.
15. Delivery
Creative Exposure provides delivery only.
Delivery is free across Grand Cayman unless a separately agreed project requirement states otherwise.
Customers are responsible for providing accurate delivery information, including the recipient, delivery address, area or district and contact number.
Creative Exposure is not responsible for delays or failed delivery caused by incorrect or incomplete information supplied by the customer.
There is no customer pickup option unless Creative Exposure expressly agrees otherwise for a particular circumstance.
16. Returns, Defects and Reprints
Because Creative Exposure products are generally customized or produced to customer specifications, they are not returnable simply because a customer changes their mind.
If there is a problem with an order, the customer must notify Creative Exposure within five (5) business days of receiving the order.
Claims may be submitted by email or WhatsApp.
Creative Exposure may request:
- photographs of the issue;
- photographs showing the entire product;
- details of the alleged defect;
- the quantity affected; and
- return of affected products where reasonably necessary to investigate the claim.
Creative Exposure will review the claim and determine an appropriate resolution based on the circumstances.
Where Creative Exposure confirms that a product is defective or was produced incorrectly because of an error attributable to Creative Exposure, the available resolution may include correction, reprinting, replacement, credit or another reasonable remedy.
A reprint or replacement does not necessarily follow the same turnaround as the original order. Creative Exposure will communicate the expected timing once the claim has been reviewed.
Problems caused by customer-supplied or customer-approved artwork are not considered production defects.
17. Quantities and Product Specifications
Customers are responsible for confirming that the product, material, size, quantity and configuration selected or stated in a quote are correct before approving an order.
Custom and quote-based projects may have additional specifications or requirements communicated to the customer before production.
18. Installation
Where installation is included or separately quoted, the customer is responsible for ensuring that Creative Exposure has reasonable access to the installation location.
Minor installation may be included with certain work.
Complex installation, specialized installation and real-estate installation may incur additional charges.
Where site conditions differ materially from the information provided when the work was quoted, Creative Exposure may advise the customer of any necessary changes before proceeding.
19. Customer Accounts
An account is required to complete a purchase through creative.ky.
Customers are responsible for maintaining the confidentiality of their account credentials and for activity occurring through their account.
You agree to provide accurate account and contact information and to update that information when necessary.
A Creative Exposure account is intended for the customer or organization to whom it is registered and should not be used fraudulently or without authorization.
Creating an account is not required merely to browse the website or request a quote.
20. Quotes
A quote is based on the information and specifications available when it is prepared.
If the requested quantity, dimensions, material, finishing, artwork, installation requirements, delivery requirements or other project specifications change, the quote may need to be revised.
Submitting a quote request does not create an order or require payment.
An order becomes subject to the applicable payment and production requirements once the customer approves the work and proceeds with the order.
21. Purchase Orders and Credit Accounts
Purchase orders may be accepted from approved organizations.
A purchase order is not a substitute for payment unless Creative Exposure has approved the organization for purchase-order or credit terms.
Approved corporate credit customers and verified government purchase-order accounts may be subject to separate written payment terms.
Creative Exposure reserves the right to require payment before production where credit or purchase-order terms have not been approved.
22. Intellectual Property and Customer Authorization
By providing Creative Exposure with logos, photographs, artwork, designs, trademarks, copyrighted works or other protected materials, you represent that you have the necessary rights and permissions for Creative Exposure to reproduce those materials as part of your order.
You authorize Creative Exposure to reproduce those materials solely as reasonably necessary to perform the requested services.
The customer remains responsible for claims arising from unauthorized use of third-party intellectual property contained in customer-supplied materials.
23. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold Creative Exposure harmless from claims, losses, liabilities and reasonable costs arising from:
- your unlawful use of creative.ky;
- your violation of these Terms and Conditions;
- materials you provide without appropriate authorization; or
- claims that customer-supplied artwork or content infringes another person’s rights.
This provision does not apply to losses caused by Creative Exposure to the extent responsibility cannot lawfully be excluded.
24. Right to Refuse Service
Creative Exposure reserves the right to refuse a project, order, artwork submission or service request where reasonably necessary, including where the requested work is unlawful, infringes another person’s rights, is abusive or fraudulent, or cannot reasonably be produced according to the requested specifications.
25. Limitation of Website Availability
Creative Exposure will make reasonable efforts to keep creative.ky available and accurate, but we do not guarantee that the website will always operate without interruption or error.
Temporary website outages do not alter an already accepted customer’s payment, artwork-approval or order obligations.
26. Privacy
Creative Exposure’s collection and use of personal information is governed by our Privacy Policy, which should be read together with these Terms and Conditions.
